These Terms and Conditions ("Terms") govern your use of BlogAmplify ("we," "us," or "our"), an AI-powered SEO blog automation platform available at blogamplify.com (the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Service Description

BlogAmplify is an AI-powered platform that helps businesses generate, optimize, and publish SEO blog content. The Service includes:

  • AI-driven website analysis and content planning
  • Automated blog post generation with web research, outlines, drafts, and images
  • A rich text editor for reviewing and refining content
  • Direct publishing to Shopify, WordPress, Notion, and custom webhooks
  • Google Search Console integration for performance tracking
  • AI-generated images for blog articles

2. Account Terms

  • You must be at least 18 years old (or the legal age of majority in your jurisdiction) to use the Service.
  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
  • One person or legal entity per account. Account sharing is not permitted.
  • You must notify us immediately of any unauthorized use of your account.

3. Third-Party Integrations

The Service uses third-party AI providers and APIs to generate content, images, and perform research on your behalf. BlogAmplify manages these integrations — you do not need to provide your own API keys or accounts with these providers.

You may connect publishing platforms (Shopify, WordPress, Notion) and Google Search Console via OAuth or credentials. By connecting these platforms, you authorize BlogAmplify to act on your behalf to publish content, read analytics data, and perform other actions necessary to provide the Service. You acknowledge that:

  • Your publishing credentials and OAuth tokens are stored encrypted at rest.
  • BlogAmplify is not liable for service interruptions, API changes, or policy updates by any third-party platform.
  • You must comply with each connected platform's terms of service.
  • Content published via BlogAmplify must comply with the content policies of the destination platform.

4. Intellectual Property

4.1 Your Content

You retain whatever rights you may have in the content generated through the Service. BlogAmplify does not claim ownership of your generated blog posts, images, or other outputs.

You grant BlogAmplify a limited, non-exclusive license to store, process, display, and transmit your content solely as necessary to provide and improve the Service.

4.2 AI-Generated Content & Copyright

Important: Copyright protection for AI-generated content varies by jurisdiction and may be limited or unavailable. As of the date of these Terms:

  • The U.S. Copyright Office has stated that purely AI-generated works without sufficient human authorship are not copyrightable.
  • Most jurisdictions have similar positions requiring human authorship for copyright protection.
  • The degree to which your creative direction (topic selection, editing, prompt crafting) confers copyright protection is an evolving legal question.

You are solely responsible for understanding and accepting the intellectual property implications of using AI-generated content in your jurisdiction. BlogAmplify makes no representations or warranties regarding the copyrightability of generated content.

4.3 BlogAmplify IP

The Service itself — including its code, design, branding, documentation, and proprietary algorithms — is and remains the intellectual property of BlogAmplify. Nothing in these Terms grants you any right to use our trademarks, logos, or branding except as necessary to identify the Service.

5. Acceptable Use

You agree not to use the Service to:

  • Generate content that is illegal, defamatory, threatening, harassing, or promotes violence
  • Create content that infringes on third-party intellectual property rights
  • Produce spam, phishing materials, or deceptive content
  • Generate content that violates the acceptable use policies of the AI providers used by the Service
  • Attempt to reverse-engineer, decompile, or extract the source code of the Service
  • Resell, sublicense, or provide third-party access to the Service without authorization
  • Circumvent security measures, rate limits, or access controls
  • Use the Service in any way that could damage, disable, or impair its functionality

We reserve the right to suspend or terminate accounts that violate these terms, with or without prior notice depending on the severity of the violation.

6. Content Accuracy & Disclaimer

AI-generated content may contain inaccuracies, hallucinations, outdated information, or unintended biases. You acknowledge and agree that:

  • BlogAmplify does not guarantee the factual accuracy, completeness, or reliability of any generated content.
  • You are solely responsible for reviewing, fact-checking, and editing all content before publishing.
  • BlogAmplify is not liable for any damages, losses, or claims resulting from the publication of AI-generated content, including but not limited to defamation claims, copyright infringement claims, or reputational harm.
  • Generated content should not be considered professional advice (legal, medical, financial, or otherwise).
  • SEO rankings and AI search citations are influenced by many factors beyond content quality. BlogAmplify does not guarantee any specific search engine ranking, traffic outcome, or AI citation.

7. Third-Party Services

The Service integrates with third-party platforms including Shopify, WordPress, Notion, Google Search Console, and various AI providers. You acknowledge that:

  • BlogAmplify is not responsible for the availability, performance, or policies of any third-party service.
  • Changes to third-party APIs, terms, or pricing may affect Service functionality.
  • Content published via BlogAmplify must comply with the content policies of the destination platform.
  • Data shared with third-party services is subject to their respective privacy policies.

8. Service Availability

We strive to provide reliable service but do not guarantee uninterrupted or error-free operation. We reserve the right to:

  • Modify, update, or discontinue features with reasonable notice
  • Perform scheduled maintenance that may temporarily affect availability
  • Suspend the Service in response to security threats or legal requirements

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • BlogAmplify's total aggregate liability to you for any claims arising from or related to the Service shall not exceed the total amount you paid to BlogAmplify in the twelve (12) months preceding the claim, or one hundred US dollars (USD $100), whichever is greater.
  • In no event shall BlogAmplify be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, profits, data, business opportunities, or goodwill.
  • BlogAmplify is specifically not liable for: search engine ranking outcomes, AI citation results, third-party service failures, content accuracy, or any actions taken by publishing platforms regarding your content.

10. Indemnification

You agree to indemnify, defend, and hold harmless BlogAmplify, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:

  • Your use of the Service or content generated through it
  • Your violation of these Terms
  • Your violation of any third-party rights, including intellectual property rights
  • Content you publish using the Service that results in third-party claims
  • Your use of third-party integrations connected through the Service

11. Termination

  • By you: You may delete your account at any time from your account settings. Upon deletion, your personal data will be removed per our Privacy Policy retention schedule.
  • By us: We may suspend or terminate your account for violation of these Terms, with notice where practicable. In cases of severe violations (illegal content, security threats), we may terminate without prior notice.
  • Effect of termination: Upon termination, you will have a 30-day grace period to export your data. After the grace period, all data associated with your account will be deleted per our retention policy.
  • Surviving clauses: Sections on Intellectual Property, Limitation of Liability, Indemnification, and Dispute Resolution survive termination.

12. Dispute Resolution

  • Governing law: These Terms are governed by and construed in accordance with applicable law.
  • Arbitration: Any disputes arising from these Terms shall be resolved through binding arbitration, conducted in English.
  • Jurisdiction: Subject to the arbitration clause, disputes shall be resolved in the courts of the jurisdiction where BlogAmplify is incorporated.
  • Individual claims: You agree to resolve disputes on an individual basis and waive any right to participate in class actions or collective proceedings, to the extent permitted by applicable law.

Note for EU consumers: Nothing in these Terms affects your mandatory consumer protection rights under applicable EU law. You may also lodge complaints with the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

13. EU AI Act Compliance

In accordance with Article 50 of the EU Artificial Intelligence Act, we disclose that content generated by BlogAmplify is produced using artificial intelligence. Users publishing AI-generated content in the European Union should be aware of their obligations to disclose AI-generated content where required by law.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email at least 15 days before they take effect. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service and delete your account.
